Confidentiality and Privacy Policy

Horizon Hope Psychological Services PLLC

To build a working relationship, there must be trust and an understanding that information revealed and addressed will remain confidential. Patients at Horizon Hope Psychological Services PLLC (“Horizon Hope”) can expect all information regarding their treatment to remain confidential unless our clinicians are legally and/or ethically bound to report to certain agencies or we have prior written authorization by the patient or their responsible party.

Confidentiality and Minors

It is important to maintain an appropriate level of confidentiality even with minor children under the age of 18. However, by law, parents or legal guardians are entitled to have knowledge of all information regarding the treatment of their child(ren). The specific level of confidentiality between the clinician and child will be discussed with all parties on a case-by-case basis.

Exceptions to Confidentiality

Our clinicians are required by law to break confidentiality under certain circumstances, including but not limited to the following:

  • If there is suspicion of abuse or neglect involving a minor, an elderly individual, or a person with a disability or mental impairment.

  • If a patient poses a serious threat of harm to themselves or others, our clinicians are obligated to contact appropriate law enforcement or medical officials.

  • If a patient has been referred by an agency such as CPS (Child Protective Services) or DARS (Department of Assistive and Rehabilitative Services), that agency is considered the client; therefore, information shared may be released to the referring agency. This will be explained at the beginning of treatment.

  • In certain legal situations, records may be subject to subpoena by a court of law.

  • If a patient’s payor source is a health insurance company, Horizon Hope may be required to release specific information as dictated by law.

  • The law permits Horizon Hope to submit limited information to a collection agency when necessary to collect an overdue account balance.

Consumer Rights Under Texas Law (HB 4224, Effective September 1, 2025)

In accordance with House Bill 4224 and Section 181.105 of the Texas Health and Safety Code, Horizon Hope Psychological Services PLLC is required to prominently provide instructions for consumers to:

  1. Request Health Care Records – Instructions for requesting your health records are available by contacting our office.

  2. Contact Licensing Authority – You may reach the Texas Behavioral Health Executive Council (BHEC) through their Contact Us webpage.

  3. File a Consumer Complaint – You may submit a consumer complaint through the Office of the Attorney General’s Consumer Protection webpage.

These rights and resources are established to protect patient privacy and ensure access to records and consumer protections under Texas law.
